Yes — Virginia allows credit surcharges; since July 1, 2025 any mandatory fee must be included in the displayed total price.
Rule: No Virginia statute bans or caps credit-card surcharges. Since July 1, 2025, Va. Code §59.1-607 et seq. (SB 1212) requires displayed prices to include all mandatory fees or surcharges, meaning fees that must be paid to buy the item. If customers can't avoid the card fee (for example, a card-only business), include it in the displayed price.
Disclosure: Include mandatory card fees in the displayed total price when the customer cannot avoid paying by card.
What this means for a $100 sale: On a $100 credit-card sale at a typical 2.9% + $0.30 rate, a compliant surcharge might be about $3.00 (customer pays about $103.00).
