New York credit card surcharge law

Yes — New York allows surcharges up to your processing cost, but you must post the full credit-card price in dollars and cents.

Rule: GBL §518 (rev. 16 Feb 2024): post the total credit-card price inclusive of the surcharge in dollars and cents — a percentage-only sign does not comply. The surcharge cannot exceed what the card company charges the business. Two-tier pricing is allowed. Penalty up to $500 per violation.

Disclosure: Post the credit-card price in dollars and cents at the point of sale and in advertising where applicable.

What this means for a $100 sale: On a $100 credit-card sale at a typical 2.9% + $0.30 rate, a compliant surcharge might be about $3.00 (customer pays about $103.00).
