Oklahoma credit card surcharge law

Yes — Oklahoma allows credit surcharges up to the lesser of 2% or your actual cost (since Nov 1, 2025).

Rule: 14A O.S. §2-211 (SB 677, eff. 1 Nov 2025) allows surcharges up to the lesser of 2% or actual processing cost. Notice is required at entry and POS (in person), on the home and checkout pages (online), and verbally by phone. No surcharge if the seller accepts only credit cards.

Disclosure: Provide required notice at entry, checkout, website, or by phone as applicable.

What this means for a $100 sale: On a $100 credit-card sale at a typical 2.9% + $0.30 rate, a compliant surcharge might be about $2.00 (customer pays about $102.00).
